1. Data Controller

The data controller in respect of Personal Data collected through this website is Proverse FZ-LLC, a company registered in the Ras Al Khaimah Economic Zone, whose registered office is at Compass Building, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates (the “Company”, “we”, “us”).

2. Categories of Personal Data Collected

2.1 Qualification form. Where a data subject completes the enquiry form hosted on this website, the Company collects: full name; email address; and business information comprising annual turnover band, typical order or client value, identity of the individual responsible for closing sales, monthly marketing expenditure, stated operational constraints, and stated commercial objectives. The form additionally records the originating page, the referring website, and any campaign parameters contained in the inbound link.

2.2 Appointment booking. Where a data subject books an appointment, the Company collects the selected date and time, together with the name and email address previously supplied.

2.3 Document requests. Where a data subject requests a copy of written materials, the Company collects the email address supplied together with the attribution parameters described at clause 2.1.

2.4 Video analytics. The Company’s video hosting provider records playback data, including whether media was played, the proportion viewed, and approximate location derived from IP address. Where a data subject has provided an email address through a form, playback data may be associated with that data subject.

2.5 Technical data. The Company’s hosting provider maintains server logs comprising IP address, browser user agent, and pages requested.

2.6 Business identification. The Company operates a business identification service which infers, from the IP address of a visitor, the organisation from which a visit originates, together with the pages requested and the time of the visit. The service is directed at identifying organisations and does not purport to identify a visitor by name.

3. Purposes and Lawful Bases of Processing

3.1 Personal Data is processed for the purposes of assessing mutual suitability prior to the provision of services; arranging and conducting a preliminary consultation; responding to enquiries; and measuring the effectiveness of the Company’s own marketing activity.

3.2 The lawful basis for processing is the legitimate interests of the Company in conducting business-to-business commercial correspondence, save where a data subject has voluntarily submitted a form, in which case processing is additionally founded on consent. Consent may be withdrawn at any time without affecting the lawfulness of processing carried out prior to withdrawal.

3.3 Personal Data is not used for automated decision-making producing legal or similarly significant effects.

4. Pre-Engagement Service Assessment

4.1 Where an appointment has been booked, the Company may, prior to that appointment, submit a genuine enquiry to the prospective client’s business through its ordinary public enquiry channels, under a name not known to that business, for the purpose of assessing the operation of the prospective client’s enquiry-handling process.

4.2 Any Personal Data of the prospective client’s personnel incidentally collected in the course of such an assessment is used solely to report findings to the prospective client during the consultation, is not disclosed to any third party, and is deleted following that consultation.

4.3 The Company discloses this practice on this website and in materials provided prior to the consultation. A prospective client may object to such an assessment at any time prior to the consultation, and the Company shall not proceed with it.

5. Disclosure to Processors and Third Parties

5.1 The Company does not sell Personal Data and does not disclose Personal Data to third parties for their own marketing purposes.

5.2 Personal Data is processed on the Company’s behalf by the following categories of processor: form and survey infrastructure (Typeform); appointment scheduling (Calendly); customer relationship management and email delivery (GoHighLevel); video hosting and analytics (Wistia); business identification (Snitcher); advertising measurement (LinkedIn Insight Tag, operated by LinkedIn Ireland Unlimited Company; and the Meta pixel and Conversions API, operated by Meta Platforms Ireland Limited); and website hosting (Vercel). Each processor receives only such Personal Data as is necessary for the performance of its function and is bound by contractual obligations of confidentiality and security.

5.3 Personal Data may be disclosed where required by applicable law, regulation, or order of a competent authority.

6. International Transfers

Certain processors are established outside the United Kingdom and the European Economic Area. Where Personal Data is transferred to such processors, the transfer is effected pursuant to the standard contractual clauses published by the relevant processor or an equivalent lawful transfer mechanism.

7. Retention

7.1 Personal Data relating to prospective clients who do not enter into an engagement is retained for a period of two years from the date of last contact, following which it is deleted.

7.2 Personal Data relating to clients is retained for the duration of the engagement and for a period of seven years thereafter, for the purpose of complying with accounting and record-keeping obligations.

7.3 Personal Data collected in the course of a pre-engagement service assessment is deleted following the consultation at which it is reported.

8. Data Subject Rights

8.1 Data subjects have the right to request access to Personal Data held about them; rectification of inaccurate Personal Data; erasure of Personal Data; restriction of or objection to processing; and portability of Personal Data provided to the Company.

8.2 Requests should be submitted to partnerships@proverseagency.com and will be responded to within thirty days of receipt. No reason need be given for any such request.

9. Cookies and Similar Technologies

9.1 Save as described at clause 9.4, this website does not set advertising cookies and does not participate in cross-site advertising networks.

9.2 The embedded form, scheduling and video components set cookies necessary for their operation, and the video component sets an identifier for the purpose of measuring playback. Cookies may be restricted through browser settings; such restriction will prevent playback measurement and will not otherwise impair the functioning of this website.

9.3 The business identification service described at clause 2.6 sets a cookie in order to recognise repeat visits from the same device and to record the pages requested. Restricting or deleting that cookie will not impair the functioning of this website.

9.4 The Company uses the LinkedIn Insight Tag, provided by LinkedIn Ireland Unlimited Company, for the purpose of measuring the effectiveness of the Company’s advertising on LinkedIn. The tag sets a cookie which enables LinkedIn to recognise a visitor who holds a LinkedIn account and to report to the Company, in aggregate form only, on the pages requested and on the completion of the enquiry form and of appointment bookings. LinkedIn’s own processing of that data is governed by its privacy policy. Restricting or deleting that cookie will not impair the functioning of this website.

10. Complaints

A data subject who considers that Personal Data has been processed otherwise than in accordance with applicable law may lodge a complaint with the Company at the address given at clause 1. Data subjects in the United Kingdom may additionally lodge a complaint with the Information Commissioner’s Office (ico.org.uk).

11. Amendments

The Company may amend this Policy from time to time. The date at the head of this page indicates when it was last revised.
